Charges will not be filed in Detroit Lakes stabbing
No charges will be filed in a stabbing that occurred in the early morning hours of July 23 in Detroit Lakes.
Joseph Warren, 37, of White Earth was stabbed in the left side of the chest. He was treated in a Fargo emergency room.
The stabbing occurred when police were called to an apartment on the 1200 block of Loring Avenue on a loud noise complaint. Before they arrived, they were informed that a fight had broken out and a man had been stabbed.
Judd Duane Beauchamp, 21, of Mahnomen was arrested at the scene without incident.
The stabbing was the result of a fight between two groups of people, according to Assistant Becker County Attorney Gretchen Thilmony.
"The evidence available at the time that a charging decision was required by law was insufficient to support a formal criminal complaint, thus the suspect was released pending further investigation," she said in a news release. "A follow-up investigation was completed and the evidence remains insufficient to support felony charges."
The evidence suggests it was a "mutual engagement," she added. "A number of the individuals involved were armed with weapons at some point."
That, along with conflicting statements from those involved, makes it impossible to "prove beyond a reasonable doubt a criminal offense," she said. "The Becker County Attorney's Office has extensively reviewed all of the investigative materials with the Detroit Lakes Police Department and both agencies have concluded that criminal charges cannot be sustained."
