Frazee man given jail for assault by strangulation
Earl McCanery III, 28, of 122 Fifth St. S.E., Frazee has been sentenced in Becker County District Court for felony domestic assault by strangulation.
According to court records:
On Sept. 15 he got into an argument with his live-in girlfriend. He grabbed her by the throat and back of the head, pushed her into a wall, and "held her with such force that she could not breath or scream. She felt he was going to kill her," according to court records.
He had assaulted her in the past, she said, but never to this degree. His blood alcohol level tested at .11 percent.
On Wednesday, District Judge Peter Irvine sentenced him to 15 months in prison, stayed three years, and placed him on supervised probation.
He must serve 90 days in jail, with credit for time served, and pay a $1,000 fine plus court fees.
