Man sentenced for assault by strangulation
Michael Barry Farley, 43, of 21804 County Road 6, Lot A9, Detroit Lakes has been sentenced in Becker County District Court for felony domestic assault by strangulation.
A gross misdemeanor charge of domestic assault was dismissed in a plea agreement.
According to court records:
On July 3, a nurse at the Park Rapids hospital reported a woman had come in for treatment after being assaulted by her significant other. She and Farley had been romantically involved for six months.
She had gone to bed at his house and he came home intoxicated and got angry at the woman. He followed her into the bathroom and hit her several times in the face. He also bent her backwards over the washer/dryer, then put a pillow over her face, causing her to have to fight for breath.
She managed to get away and was nearly out of the bathroom when he started punching her again. She lay on the floor in a fetal position until he allowed her to get up and leave the residence.
At the time, he was on probation for a domestic assault by strangulation charge against the same woman.
He was sentenced by District Judge Joe Evans to 21 months in prison, execution of sentence stayed four years. He was placed on supervised probation and ordered to serve 75 days in jail, with credit for five days served.
He was fined $1,000 plus court fees, but can do STS work in lieu of the fine. He was ordered to abstain from drugs and alcohol and complete domestic abuse group counseling.
