Ponsford man sentenced for slapping, pushing girlfriend
Michael Joshua Burciaga, 22, of 28284 County Road 129, Ponsford has been sentenced in Becker County District Court for gross misdemeanor harassment.
The charge was originally a felony but was reduced in a plea agreement. Three other felony assault charges were dropped.
According to court records, on June 23, police were called to a residence in Pine Point on a domestic assault report. Burciaga had allegedly slapped and pushed his live-in girlfriend and mother of his three young children.
He was convicted of domestic assault against the same victim in March 2008, and convicted of interfering with the same victim's 911 emergency call in November of 2008. He was also convicted of harassment against the same victim in March of 2009.
On Monday, District Judge Joe Evans sentenced him to 365 days in jail, the balance stayed for two years. He had already served 82 days in jail.
He was fined $1,000 plus court fees and ordered to have no contact with the victim until authorized by the group leader of his domestic abuse program.
He was ordered to enroll and complete his GED, and abide by the curfew set by his probation agent. He was taken directly to Pine Manor for inpatient chemical dependency treatment.
He must successfully complete a domestic abuse treatment program, abstain from drugs and alcohol and submit to random testing, among other conditions.
