Calvin Lee Jackson, 60, of 36095 Lynx Lane, White Earth, is also facing a gross misdemeanor charge of driving after license cancellation in connection with the Aug. 9 incident in White Earth.

A law enforcement officer spotted Jackson behind the wheel of a pickup being driven in White Earth, and knew his license had been canceled. The vehicle also had a cracked windshield, and Jackson reportedly was not wearing a seat belt.

The officer initiated a traffic stop on County Road 34 at a little after 8 p.m., and noticed that Jackson, the driver, had a strong odor of alcohol on him as well as bloodshot, watery eyes and slurred speech. Jackson allegedly admitted that he'd consumed five cans of beer, and performed poorly on a field sobriety test.

A preliminary breath test administered at the scene showed his blood alcohol level to be at .25. A second test administered at the jail at just before 9:30 p.m. showed his alcohol level to still be at .19. He also reportedly has a prior conviction for felony DWI from 2003, and a canceled driver's license.

Jackson is in custody at the Becker County Jail awaiting his next court appearance, at a Sept. 4 omnibus hearing. His bail was set at $20,000 with conditions, or $50,000 without conditions.
