DL man sentenced for drugs

Marshall Lee Johnson, 30, of 21001 County Road 22, Detroit Lakes was sentenced in Becker County District Court Friday for felony fifth-degree controlled substance crime, possession.

According to court records: he was stopped on Highway 10 on June 28 for driving 74 mph in a 65 mph zone. The trooper smelled alcohol in the vehicle, and Johnson's blood alcohol level tested at .09 percent.

His vehicle was searched during the arrest process, and the trooper found a number of small plastic baggies in the glove box, some containing cocaine and some containing methamphetamines.

Similar packets were found on Johnson's person when he was searched during the booking process at the Becker County Jail.

He pleaded guilty Oct. 9 to felony fifth-degree controlled substance crime, possession. An identical charge was dropped in a plea agreement. He was also charged with gross misdemeanor DWI.

On Friday, District Judge Joe Evans stayed imposition of sentence and placed Johnson on supervised probation for five years. He was ordered to serve 30 days in jail, with credit for four days served, and with work release and STS privileges granted.

He must pay a $1,000 fine plus court fees, be law abiding, and get a chemical use assessment and follow the recommendations.
