N.D. man sentenced for possessing pot

Kevin Allen Cross, 23, of Williston, N.D., has been sentenced in Becker County District Court for felony fifth-degree controlled substance crime -- possession, and driving after his license was canceled, a gross misdemeanor.

According to court records, he was pulled over July 18 in Detroit Lakes by a police officer who saw him driving without wearing a seat belt.

There was a strong odor of marijuana in the vehicle and an open bottle of beer in the back seat.

A search of the vehicle revealed a bag containing three smaller baggies of marijuana -- weighing 24.72 grams, 26.45 grams and 27.98 grams. There was also $482 cash.

His license had been canceled earlier as inimical to public safety.

Cross appeared before Becker County District Court Judge Joe Evans, who placed him on supervised probation for five years and ordered him to serve 30 days in jail, with credit for three days served. STS privileges were granted. He was fined $1,000 plus court fees.

He was also sentenced to 30 days on the second count, to be served concurrently. Another 335 days in jail was stayed two years.

He was fined another $500 on the second charge, for a total fine and fees of $1,590.
