A felony charge against a West Fargo woman was dismissed Monday in Becker County District Court.

Devin Faye Simonson, 30, of 652 Pheasant Run, West Fargo, was facing a felony charge of issuing dishonored checks.

The charge stemmed from a Nov. 26, 2009 incident in which she allegedly wrote a $535.80 check to Central Market in Detroit Lakes, using an account later identified as being closed.

According to the court order, signed by Assistant County Attorney Jennifer Jacobs, the complaint was dismissed because the defendant had established a "valid alibi defense," which meant the state was "unable to meet its burden of proof beyond a reasonable doubt."
