Court news: Lake Park man ordered to pay $20,000 restitution in bar assault case

Adam Michael Wolfswinkle, 22, of Lake Park, has been ordered to pay over $20,000 in restitution in Becker County District Court for an assault outside the Lake Park Liquor Store.

Wolfswinkel was sentenced April 28 for felony third-degree assault. A misdemeanor fifth-degree assault charge was dropped in a plea agreement.

According to court records, on Nov. 17, 2019, the victim told a Becker County deputy that he had been at the Lake Park Liquor Store the evening before, and had gotten into an argument with two men about vehicles. One came up to him, put his arm around his shoulders, and told him he should apologize to his friend.

That was the last thing the victim remembered. He drove home, woke up his wife, and she saw he was covered in blood. The deputy observed that his face was swollen, with two black eyes.

Witnesses and surveillance video pointed to Wolfswinkel as the assailant, and the victim never threw a punch or took a swing at him, according to a witness.

Wolfswinkel admitted hitting the victim, and told the officer that he had been drinking, “which didn’t help.” The victim suffered two broken upper teeth and several broken bones in the nose, according to court records.

On April 28, District Judge Michael Fritz stayed imposition of sentence and placed Wolfswinkel on supervised probation for five years.

He was ordered to serve 15 days in jail, with work release privileges granted, and pay a $500 fine and $575 in court fees.

Wolfswinkel was also ordered to pay $16,860 in restitution to the victim, and another $3,322 in restitution to the Minnesota Crime Reparations Board.

He must get a chemical dependency evaluation and follow the recommendations, including aftercare.

Frazee man sentenced to complete Veterans Court program

Jesse Glenn Olson, 38, of rural Frazee, has been sentenced in Becker County District Court for felony fleeing a peace officer in a motor vehicle.

According to court records, on Dec. 26 police were called to KFC restaurant in Detroit Lakes because he was behaving erratically in the drive-thru, squealing his vehicle tires and spitting on the drive-thru kiosk. He would only roll down his window 6 inches when the officer tried to talk to him, but the vehicle smelled of alcohol, and Olson drove away from the officer, over a boulevard and onto the frontage road before stopping about three blocks away.

On April 28, District Judge Gretchen Thilmony stayed adjudication of sentence and continued the case.

Olson was ordered to serve two days in jail, with credit for two days served. He was fined $500, plus $575 in court fees, and must successfully complete the Becker County Veterans Court program, and follow the recommendations from a recent chemical dependency treatment program, including aftercare.

He was also sentenced on a misdemeanor DWI charge, to 90 days in jail, with 88 days stayed two years and credit for two day served. He was fined $25 and placed on supervised probation for two years.

Detroit Lakes man must pay $3K restitution for vandalizing car

Kyle James Bachmeier, 34, of Detroit Lakes, has been ordered to pay restitution in Becker County District Court for felony first-degree criminal damage to property.

According to court records, on Oct. 11, 2020, he put several dents, scratches and metal gouges in his ex-girlfriend’s car, parked outside her apartment building.

He was sentenced earlier, and District Judge Michael Fritz recently ordered Bachmeier to pay $3,058 in restitution.

Detroit Lakes man charged with being fugitive from justice

Mitchell Ray Sandberg, 31, of Detroit Lakes, has been charged in Becker County District Court with felony being a fugitive from justice from another state.

According to court records, on March 30, a Detroit Lakes police officer was called to Walmart on the report of suspicious activity. The officer made contact with Sandberg and found he was wanted on a Cass County, N.D., warrant from Nov. 9, 2020, on a felony drug probation violation.

On April 27, he waived his extradition rights and agreed to return to North Dakota to face the charges.

Man must pay $2,700 restitution for attack on doctor

Nicholas John Endriss, 24, of Hackensack, has been ordered to pay $2,721 in restitution following a July 15 attack on an emergency room doctor at Essentia Health St. Mary’s.

According to court records, on July 15, law enforcement was called to Essentia Health St. Mary’s hospital to help with Endriss, who had grabbed a doctor by the neck and tried to take him to the floor.

Earlier that evening, he had threatened to kill the doctor, and threatened to kill him again when he had him by the throat, according to the criminal complaint. A nurse witnessed the assault, and hospital security assisted the doctor until police arrived.

He was sentenced in January in Becker County District Court on a felony charge of making violent threats, but the restitution amount was only recently established.

Felony charge of violating no-contact order dismissed after verdict

Virgil Marquis Smith, 29, of Snellville, Ga., has had a felony charge of violating a no-contact order dismissed in Becker County District Court.

According to court records, on July 1, he sent two texts to a Lake Park woman in violation of a domestic abuse no-contact order.

On April 26, the Becker County Attorney’s Office dismissed the charge because Smith had earlier been acquitted in the underlying case in which the protection order had been issued.

Drug charge dropped, woman sentenced for theft

Leeann Marie Seely, 33, of Arthur, N.D., has been sentenced in Becker County District Court for misdemeanor theft.

A felony fifth-degree charge of controlled substance crime was dropped in a plea agreement.

According to court records, on Jan. 30 she was caught with $110 worth of stolen items outside the Detroit Lakes Walmart. She was wearing a fanny pack that was found to contain two syringes and .85 grams of meth.

On April 27, Becker County District Judge Jay Carlson ordered her to serve 90 days in jail, with credit for 90 days served. She is currently in prison and credit was given for jail time served. She was fined $50, plus $235 in court fees and $35 in restitution.
