Court news: Report of riot at tubing area leads to DWI sentence for Park Rapids man

There were several knives and drug paraphernalia on the passenger seat, and the vehicle smelled strongly of alcohol.

Aaron Robert Jantz, 36, of rural Park Rapids, has been sentenced in Becker County District Court on a gross misdemeanor DWI charge.

A second gross misdemeanor DWI charge and a felony charge of fifth-degree controlled substance crime were dropped in a plea agreement.

According to court records, on Aug. 3, 2019, a Minnesota State Patrol trooper on Highway 34 received a report of a riot at the tube rental area. Multiple vehicles had left, and the complainant wanted them found. The trooper stopped Jantz’s vehicle after it left a parking lot at the tube rental area and was driving 70 mph in a 60 mph zone on Highway 34

There were several knives and drug paraphernalia on the passenger seat, and the vehicle smelled strongly of alcohol. A search of the vehicle turned up oxycodone pills and some marijuana. Jantz’s blood alcohol level tested at .09%. He was previously convicted of DWI in 2017 in Hubbard County.

On May 11, District Judge Gretchen Thilmony sentenced Jantz to serve 210 days in jail, with 180 days stayed for six years, and credit for three days served. He can do the remaining 15 days of his sentence on electronic home monitoring. He was ordered to get a chemical dependency evaluation and follow the recommendations, including aftercare, and was placed on unsupervised probation for six years.

Detroit Lakes man sentenced for heroin

Justin Michael Mayberry, 42, of Detroit Lakes, has been sentenced in Becker County District Court on a felony charge of third-degree controlled substance crime.

A felony charge of fifth-degree controlled substance crime was dropped in a plea agreement.

According to court records, on Aug. 25, 2020, a state trooper received information that a vehicle was returning from the Twin Cities transporting heroin to Detroit Lakes. The trooper saw the vehicle go through a stop sign 260th Avenue and 130th Street in Becker County, and pulled it over. Mayberry was a passenger, and two grams of heroin were found in his front pocket.

The driver, Garrett William Frank, 42, had 11 grams of heroin on him, according to the criminal complaint.

On May 10, District Judge Gretchen Thilmony stayed imposition of sentence and placed Mayberry on supervised probation for 10 years.

He was ordered to serve 60 days in jail, with credit for two 2 days served, and was fined $800 plus $965 in court fees, and $500 in restitution.

Mayberry was ordered to get a chemical dependency evaluation and follow the recommendations, including aftercare.

Fargo woman sentenced after being pulled over in stolen Nissan

Taylor Briann Roscoe, 28, of Fargo, has been sentenced in Becker County District Court on a felony charge receiving stolen property.

According to court records, on Jan. 20, 2020 a White Earth police officer saw a 2017 Nissan Versa, without license plates and with a broken windshield, going south on 336th Avenue in Becker County.

Roscoe was a passenger in the backseat, and said she owned the car and had bought it Jan. 17, 2020. She produced a title with an illegible buyer’s signature and no seller’s signature. The Nissan had been stolen late Jan. 18 or early Jan. 19, according to the criminal complaint.

On May 3, District Judge Michael Fritz stayed imposition of sentence and ordered Roscoe to serve 42 days in jail, with credit for 42 days served.

She was fined $1,000 plus $1,150 in court fees, and was ordered to get a complete diagnostic assessment and a chemical dependency evaluation and follow the recommendations, including aftercare. She was placed on supervised probation for five years.

Burglary charge dismissed against Ponsford man

Joseph Adam Crowell, 30, of rural Ponsford, had a felony charge of third-degree burglary dismissed in Becker County District Court.

According to court records, on Dec. 1, 2020, he entered the Walmart in Detroit Lakes, in violation of a no-trespass issued nearly a year earlier. Store video allegedly showed him putting $134 worth of goods in his pocket and leaving the store without paying.

It was the 10th time in two years he was accused of shoplifting at a Walmart.

On May 3, the charge was dismissed by the Becker County Attorney’s Office because it was “unable to sustain the burden of proof that the defendant committed the offense,” according to court records.
