Failure to return children results in jail, probation

On Dec. 3 he failed to return his two minor children, ages 5 and 7, to their mother after a visit. The mother has sole legal and physical custody. He took the children out-of-state.

District Judge Jack Pearson sentenced him to a year and a day in prison, execution of sentence stayed four years.

He was placed on supervised probation and ordered to serve six months in jail, with Sentencing to Service privileges granted. He was fined $500 plus court fees and was ordered to have no contact with the children or their mother, unless ordered by the court.

He must complete a cognitive skills program if so recommended by his probation officer.
