Man sentenced for selling drugs in school area

According to court records:

On Sept. 29, 2008, a confidential reliable informant working for the West Central Minnesota Drug Task Force bought 2.4 grams of cocaine for $300 from two men in a car at the M&H convenience store parking lot in Detroit Lakes.

The area is within a school zone. Smith was involved in the sale.

He appeared Feb. 22 before District Judge Joe Evans, who sentenced him to four years in prison, execution of sentence stayed 25 years. He was placed on supervised probation.

The stayed prison sentence was a downward departure from state sentencing guidelines.

Evans granted the lighter sentence based on Smith's young age, absence of significant criminal history, the minor role he played in the drug sale, his cooperation with authorities, his acceptance into the drug court program and his presumed ability to do well on probation.

Smith must serve 180 days in jail, with credit for 24 days served and work release privileges granted.

He must pay a $1,000 fine plus court fees, and abstain from alcohol and drugs, submit to random testing, complete a gambling assessment, and follow the recommendations of a chemical dependency evaluation.
