WILLMAR -- The Minnesota Court of Appeals has reversed a drug conviction for an Atwater man accused of manufacturing methamphetamine.
The appeals court ruled the district court erred in determining that Darryl Kise's father had the authority to allow law enforcement officers to search his home and the basement where his son lived. Officers say they found a meth lab in the basement.
The 55-year-old Kise was sentenced in November 2008 to about six years in prison.
The West Central Tribune reports the case will return to the Kandiyohi County Attorney's Office where prosecutors will decide how to proceed with the case.
